We have had a recent surge of calls lately regarding whether Chapter 128 filings will stop WE Energies shutoffs. Unfortunately while that used to be the case, in Milwaukee you are no longer able to use a Chapter 128 to prevent a shutoff or to get reconnected once WE has discontinued your service for nonpayment. As you may know, a Chapter 128 is a Voluntary Amortization of Debt plan where unsecured debts can be placed in a repayment plan and paid back to creditors on a pro-rata basis for as long as 36 months. This can be useful for one or two problematic debts in certain situations. But if you live in Milwaukee and are facing a shutoff by WE Energies, please contact us immediately to discuss other solutions. Chapter 7 and Chapter 13 bankruptcy may be available and often are a better alternative to a Chapter 128. A Chapter 13 lets you pay back based on your income rather than what you owe WE, and this can be very helpful.
