The Bankruptcy Process
What should you expect during the bankruptcy process? At Miller & Miller Law, LLC, we strive to make the bankruptcy process as easy and stress-free as possible. We want you to feel comfortable with the decisions you are making, and we want to help you by providing the guidance you need to rebuild your life once your bankruptcy is complete.
The Initial Consultation
At our first meeting, we will review your complete financial situation and provide you with an evaluation of your situation, your options for moving forward and our recommendation about what bankruptcy, if any, is right for you.
Prior To Filing
Once you have retained our firm, we will have you provide us with any additional information or documentation we need to assemble your case. You may also direct any creditors or debt collection companies to call our firm.
Filing Your Case
Once we have assembled your case, we will review it with you, then electronically file it with the U.S. Bankruptcy Court. As soon as your case has been filed, you may give your file number to anyone who attempts to contact you regarding a debt.
Your Court Appearance
You will be required to make a court appearance roughly one month after your bankruptcy is filed. This appearance is known as the 341 hearing or meeting of creditors. The 341 hearing is an opportunity for the bankruptcy trustee to ask questions and verify that the contents of the bankruptcy petition are true. It is important to note that although the hearing is often referred to as the “meeting of creditors,” creditors very seldom show up. If you are pursuing Chapter 13 bankruptcy, the bankruptcy trustee will also review and approve your proposed bankruptcy plan.
After Your Court Appearance
Once your court appearance is complete, you will be required to take a course in financial management. You have a limited period of time to complete this. We generally encourage people to complete it as soon as possible. It is a very short course. In the case of Chapter 7 bankruptcy, it will take approximately 60 days from the date of the court hearing before you receive your discharge. If you are pursuing Chapter 13 bankruptcy, your unsecured debts will be discharged upon completion of your plan.
