The reaffirming of debts seems to be a hot topic of late. There are advantages and disadvantages of why one may reaffirm a debt in their bankruptcy and why one would not reaffirm their debt. This posting will discuss reasons why debts may not be reaffirmed:

The income and expenses show that one cannot afford to reaffirm;

If someone is upside down on their house or car and reaffirming makes no sense (in other words you owe more than the house or car are worth);

The mortgage or auto company never cooperated in sending us a reaffirmation agreement;

Some mortgage or auto company simply do not entertain reaffirmation agreements.

Reaffirming a debt is a voluntary decision on behalf of the debtor and creditor and is not an obligation.
