Is your holiday shopping completed? Are you waiting for the After-Christmas Sales? Many consumers who have been considering filing a Chapter 7 or Chapter 13 may have to wait at least 90 days before they can file if they used credit cards.
Credit card debt made 90 days prior to filing for bankruptcy is non-dischargeable and only necessities (food, utilities, etc) on that debt created 90 to 180 days prior maybe dischargeable. The non-dischargeable debts may be reaffirmed or redeemed so you ultimately will be responsible for those Christmas presents.
